The Latest Changes to Ontario’s Excess Soil Regulations: How Owners, Contractors and Excavation Trades Can Manage Evolving Risks
The tenth round of changes to O Reg 406/19 (Excess Soils) came into effect late last year, coming with it a delay to the prohibition on the deposit of excess soil at landfilling or dump sites, which has been pushed to January 1, 2027, and greater flexibility in both types of reuse projects and types of excess soils appropriate for reuse. Join us as we provide an overview of the structure and technical requirements (as well as the latest changes) to Ontario’s excess soil regulation with our guest, Stacy Meek, who is an environmental engineer and qualified person (QP) at EXP Services Inc.
Navigating Ontario Construction Settlements: Partial Settlements, Disclosure Obligations, and Recent Developments in Ontario Case Law
In Ontario, settling a construction dispute requires navigating agreed upon terms and the strict provisions of the Construction Act. The process is rarely a simple two-party handshake, as obligations are owed to others on the project and all are bound by statutory provisions and trust obligations. Join us to discuss settlements, partial settlement, disclosure obligations, recent decisions of Ontario Courts, and everything in between.
You’ve received a Notice of Adjudication! – Adjudication from the Respondent’s Perspective
You’ve received a Notice of Adjudication, what now? In this webinar, we will discuss our experience with adjudication of construction contracts in Ontario from the Respondent’s lens. We will walk you through the timelines and processes of how to participate in an adjudication as a Respondent and the consequence of burying your head in the sand and not participating. Further, as construction disputes are increasingly directed to adjudication, we will guide you on how to best protect yourself on a day to day basis throughout work on your construction improvement.
After the Award: How to Collect and Enforce a Determination, Order, Or Judgement
In this webinar, we will discuss Garnishment, Examination, Writs of Seizure and Sale, Liens, and calculating interest. We will walk you through the steps to enforce your rights and affect recovery of the debt you are owed with a successful order, judgment, or determination. From seeking recovery from “judgment-proof” parties and those who would seek to conceal their funds and assets to those who are “good for it” and whom you may want to continue a business relationship with, we will discuss the best way to approach each debtor on a case-by-case basis.
So You’re Unhappy with the Result? Appeals and Judicial Review of Construction Related Decisions
In litigation, there is always a chance (even if slim) of being on the receiving end of an unexpected and unfavorable decision from a Judge or Adjudicator. Unsuccessful parties often need to decide quickly whether to challenge a decision, on what basis they can challenge a decision, and in what forum they need to bring (or request leave/permission) an appeal and/or judicial review. Join lawyers from Kennaley Construction Law in conversation about what the processes of appeal and judicial review involve, as well as strategic considerations for you to help decide what may be the next right move when the time comes.
