Risks and Possibilities Associated with Emerging Technologies, including AI, in the Construction Industry in Canada

When opportunity knocks, someone will open a door. Entrepreneurs have been developing technology for use in the construction space for years. Building Information Modeling (BIM) was first developed in the 1970s, gaining significant traction in the early 21st century, software which tracks the movement and use of workers and equipment is becoming increasingly sophisticated and the use of project management software (like Procore and Buildertrend) is becoming common place. Now, as Artificial Intelligence takes a foothold in virtually every aspect of our day-to-day lives, the risks and potential associated with technology in the construction space have suddenly become (or need to become) timely issues for consideration. In this webinar, we will discuss the good, bad and potentially ugly associated with emerging technologies in construction, including the range of possible uses for AI, cyber-security and privacy concerns in relation to data and the risks associated with a reliance on AI, including the potential for AI “hallucinations”.

Negotiating Contracts and Subcontracts: A Panel Discussion with Experienced Guests

Marcia Oliver, Paige Crewson, Chris Moran and Rob Kennaley have, between them, almost 100 years of construction law experience, much of it in negotiating contracts and subcontracts, both as external and in-house counsel, in relation to a myriad of contract models and project types, sizes and dollar values. In this Webinar, Rob will lead our panel through a roundtable discussion of a series of topics, including over-all strategies, emerging models, recent trends in attempts to “push the envelope”, lessons learned from other jurisdictions, the importance of dovetailing contracts to the Construction Act, specific needs based on recent developments in the case law and the relationship between in-house and external counsel. Join us to hear from those with a wealth of experience and knowledge!

Managing the Risk of Tariffs in Construction

On April 4, 2025, further tariffs are set to be imposed by the United States on certain Canadian goods being exported into the US. In response, both the federal and provincial governments have indicated that they will respond with further tariffs on American goods entering Canada. Tariffs, and the uncertainty of tariffs, will have continuing direct and indirect impacts on the cost of construction in Canada. Accordingly, the need to understand and prepare for the risk of tariffs is a new reality for construction participants in Ontario. In this Webinar, lawyers from Kennaley Construction Law will discuss how to manage the risk and impacts of tariffs under both current and future contracts. This Webinar is part of a series in which we offer free 1 hour seminars every Tuesday morning, from 8:30 – 9:30 am, on a variety of timely issues and topics. Our goal is to provide focused and practical information, and to conclude each session on the hour with additional time then set aside for questions and discussion for those that want to stay behind.
